Per l'uscita definitiva di un lotto dal territorio italiano: Per i lotti "antichi" (relativi a beni realizzati da oltre 70 anni da autori non più viventi) ma con un valore (prezzo di aggiudicazione) inferiore o uguale a 13.500 euro al netto delle commissioni d'asta occorre una autocertificazione vidimata dall'ufficio di esportazione, oltre alla licenza comunitaria prevista dal Regolamento 116/2009, nei casi in cui la stessa sia richiesta per l'uscita dal territorio dell'Unione Europea: il tempo di attesa per ottenere i suddeetti documenti é normalmente da due settimane a tre mesi. Qualora il prezzo di aggiudicazione di un lotto sia superiore ai 13.500 euro, occorre un attestato di libera circolazione rilasciato dall'ufficio esportazione, oltre alla licenza comunitaria prevista dal Regolamento 116/2009, nei casi in cui l&a stessa sia richiesta per l'uscita fuori dal territorio dell'Unione Europea. I tempi di attesa potrebbero essere più lunghi.

Il rilascio di una autocertificazione ovvero di un attestato di libera circolazione, a seconda dei casi, deve avvenire a cura e spese degli acquirenti. I lotti potranno essere ritirati a spese degli acquirenti presso la dimora privata, previo pagamento tramite carta di credito o prova del bonifico e unicamente su appuntamento, dal 28 al 30 settembre 2023 dalle ore 10h30 alle ore 18h00. Dopo il 30 settembre 2023, gli eventuali acquirenti che non avessero potuto ancora ritirare i loro lotti, potranno farlo a loro spese presso la propriétà, previo pagamento e unicamente tramite appuntamento in alcune date precise, esclusivamente entro il 30 ottobre 2023.

Dopo il 30 ottobre 2023, ogni lotto non ancora ritirato sarà affidato al trasportatore milanese Art Service S.r.l., a spese degli acquirenti, compresi i lotti necessitanti dei documenti d'esportazione fuori Italia. Preventivi di consegna / esportazione potranno esser forniti dal trasportatore stesso.

Terms and conditions of sale
Il prezzo di vendita sarà denominato in euro. In aggiunta al prezzo di
aggiudicazione, gli acquirenti pagheranno le commissioni seguenti : fino a
150 000 €, 30,5% IVA inclusa (ovvero 25% + 22% d'IVA) ; da 150 000 € a
500 000 €, 26,23% IVA inclusa (ovvero 21,5 % + 22% d'IVA) ed oltre 500
000 €,21,96% IVA inclusa (ovvero 18% + 22% d'IVA). Questo calcolo si
applica per lotto e per fascia.
Il pagamento deve esser effettuato subito dopo l'asta. Tale regola é applicabile
anche qualora l'acquirente desiderasse fare uscire definitivamente il lotto
dal territorio italiano o in base ad un'autocertificazione ovvero in forza di un
attestato di libera circolazione, a seconda dei casi. L'aggiudicatario potrà
pagare tramite : bonifico bancario in euro, carta Visa o Master Card, e
Amex ; in contanti fino a un limite
uguale o inferiore a 1 000 € e tasse comprese. Millon aderisce al Registro
centrale di prevenezione degli insoluti dei Commissaires Priseurs (banditori
d'asta francesi), presso il quale gli incidenti di pagamento possono essere
registrati. I diritti di accesso, rettifica e opposizione per motivi legittimi sono
esercitabili da parte del debitore presso lo Symev 15 rue Freycinet 75016
Parigi.
ASTA DAL VIVO
Gli acquirenti che hanno acquistato il loro lotto o i loro lotti attraverso una
piattaforma di vendita online pagheranno in più :
- per i lotti acquistati tramite la piattaforma Drouotonline, le spese di vendita
a carico dell'acquirente sono maggiorate dell'1,5% (IVA esclusa) del prezzo
d'asta (cfr. CGV della piattaforma Drouot.com).
- per i lotti acquistati tramite la piattaforma Invaluable, le spese di vendita
a carico dell'acquirente sono maggiorate del 3% (IVA esclusa) del prezzo
d'asta (cfr. CGV della piattaforma Invaluable.com).
DIRITTO DI SEGUITO
Millon é legalmente tenuta a raccogliere le somme
dovute a titolo del diritto di seguito per la vendita dei lotti e a riversarli
all'ente preposto alla riscossione o al beneficiario del diritto.
Il pagamento del diritto di seguito é a carico dell'acquirente, e gli sarà
fatturato contemporaneamente al prezzo di aggiudicazione e alle
commissioni oggetto del primo paragrafo.
Nel caso in cui Millon prendesse conoscenza dell'assoggettamento di una
vendita al diritto di seguito solo successivamente all'aggiudicazione
di un lotto, il corrispondente importo sarà addebitato all'acquirente in modo
separato e ulteriore.
L'importo su cui è calcolato il diritto di seguito è iI prezzo di aggiudicazione.
Esso si calcola lotto per lotto. Il tasso applicabile é di :
- 4% per la fascia di prezzo fino a 50 000 €
- 3% per la fascia di prezzo compresa tra 50 000,01 € e 200 000 €
- 1% per la fascia di prezzo compresa tra 200 000,01 € e 350 000 €
- 0.5% per la fascia di prezzo compresa tra 350 000,01 € e 500 000 €
- 0.25% per la fascia di prezzo oltre 500 000,01 €
L'importo del diritto di seguito è limitato a 12 500 €.
GARANZIE
Millon assume la responsabilità delle indicazioni riportate nel catalogo, fatte
salve le eventuali rettifiche annunciate al momento della presentazione del
lotto e riportate nel processo verbale dell'asta.
Lo stato di conservazione di un lotto e, in particolare, la circostanza
che tale lotto sia stato danneggiato o restaurato, é indicato nel catalogo
d'asta per facilitare l'ispezione del lotto stesso, ma rimane soggetto a una
valutazione personale dell'acquirente o del suo rappresentante. L'assenza
di una simile indicazione nel catalogo non implica in nessun modo che un
lotto sia esente da possibili danni o difetti o restauri.
L'esposizione preliminare permette di esaminare lo stato dei beni e, in tal modo
modo, nessun reclamo sarà possibile in relazione a restauri o danni.
OFFER
Le offerte seguono l'ordine dei numeri del catalogo. Millon é libera di fissare
l'ordine di progressione dell'asta e gli offerenti sono tenuti a conformarvisi.
Il migliore e ultimo offerente sarà l'aggiudicatario. In caso dippia offerta
riconosciuta come effettiva da parte di Millon, il lotto sarà rimesso in
vendita, e tutti gli interessati potranno concorrere a tale seconda messa
in asta. Dal momento dell'aggiudicazione, i lotti saranno posti sotto l'intera
responsabilità dell'acquirente. Sarà suo compito di assicurare i lotti dal
momento dell'aggiudicazione.
ORDINI D'ACQUISTO E OFFERTE TELEFONICHE
Ogni offerente che desidera fare un'offerta di acquisto per iscritto o
partecipare telefonicamente all'asta, può utilizzare il formulario previsto
a tale scopo alla fine del catalogo. Esso deve giungere a Millon entro due
giorni prima l'asta, accompagnato dalle coordinate bancarie dell'offerente.
Le offerte telefoniche sono un servizio gratuito reso ai clienti che non hanno
la possibilità di spostarsi fisicamente. In nessun caso Millon potrà essere
ritenuta responsabile di un problema di linea telefonica e in nessun caso
gli impiegati di Millon potranno esser ritenuti responsabili in caso di errore.
RITIRO DEI LOTTI ACQUISTATI
I COSTI E I RISCHI DI RITIRO, TRASPORTO E DELLEVENTUALE USCITA DAL TERRITORIO ITALIANO SARANNO A CARICO DEGLI ACQUIRENTI. LA CASA D'ASTE DECLINA OGNI

DATI PERSONALI
La Casa d'Aste si impegna a rispettare la regolamentazione in vigore
applicabile al trattamento dei dati personali ed in particolare, il regolamento
(UE) 2016/679 del Parlamento Europeo e del Consiglio applicabile a partire
dal 25 maggio 2018 (GDPR) e la legge n°78-17 del 6 gennaio 1978 e
successive modifiche, detta " Legge Informatica e Libertà ".
CONDITIONS OF SALE
